How is property divided in a divorce?
Property in Texas is divided based on its status of either community or separate property. Community property is generally split equally as it is seen as being owned equally by the spouses. Separate property is property that is owned by one of the parties in the divorce and is retained by that person following the divorce. The majority of property acquired during a marriage will be deemed community property.
